Operationalizing ethics - mission impossible or next level of Compliance?

Ethics, Integrity and Compliance, are these all different concepts or are they belonging all together? How can we build in companies an effective assurance system but not neglecting ethical dilemmas our employees and external stakeholders are debating? Let us discuss if and how we can operationalize ethics as part of an effective Compliance Management System.

Myths and Reality in the Boardroom
Myths and Reality in the Boardroom

While there has never been as many laws, self-regulation (codes), trainings, evaluations, governance measurements (ESG), tools, tech and controls, the situation in the boardrooms hardly evolved in reality, even if it changed on paper. It remains true that good governance is a complex chemistry hardly compatible with narcissism and risk adversity.  Next to the characteristics included in the codes, it much depends on the values and courage of the members around the table, the culture and board dynamics and the attitude of the Chair.

Ethics & Compliance: 2 levers of opportunity for companies and organisations? Feedback from France.
Ethics & Compliance: 2 levers of opportunity for companies and organisations? Feedback from France.

*The session will be hold in french with live translation in English.*

Thanks to Michel Sapin, ex minister of finance who had a highly distinguished French political career, France has been a front runner in Europe with the adoption of an anti-corruption law that bears his name - the "Sapin 2 Law". This law has required companies, among other requirements, to set up an internal whistleblowing system since June 2017.

Here are the topics that will be discussed during this interview:

• What is the genesis of this law? What is the assessment and what are the lessons learned from it after 4 years of implementation?

• Why is it so important for compliance and ethics professionals to see these laws as a real opportunity and not as a burden?

• And finally, what would be useful tips for businesses across the EU?

Measuring Compliance Culture
Measuring Compliance Culture

As every Compliance Officer knows, industry enforcement bodies place increasingly high priority on a “culture of compliance” and “tone at the top” in their guidance for establishing and maintaining a robust compliance program. But what does that mean in practice? How do you know if your culture has unrecognized stress points and how do you create an environment in which a culture of compliance can flourish in the same way safety culture does in so many organizations? When firmly embedded in the culture, ethics and compliance can be a competitive advantage and contribute to a stellar corporate reputation. But to get there, you have to know where you are today and where the pressure is coming from to disregard compliance requirements. Many compliance programs measure operational risk management factors, too few still measure the impact of the human factor. This workshop looks at how we define and map a culture of compliance and shares a case study of how to measure it in order to pinpoint strengths and weaknesses.

As of 2021, approximately 1.145 trillion MB of data are created per day. While the continuous increase of information available to identify, investigate and remediate compliance irregularities brings along unprecedented opportunities in the space of compliance and investigation, it also poses challenges to investigation efficiency. AlixPartners’ keynote will deliver practical insights on intelligent digital investigation techniques ranging from specific pattern analyses, to data visualization, to proprietary eDiscovery tools used to drive investigation efficiency and effectiveness.

With the ECEC Award, we honor exceptional Compliance efforts which have the power to inspire the Compliance community. We are looking for single projects in an organization’s Compliance area; it is not the idea to award the entire Compliance program or Compliance organization in general.

Rather we are looking for innovative approaches and measures which have proven to be particularly effective – this might be a notable Compliance communication campaign, a sophisticated KPI measurement model or a difficult internal change management project.

The importance of employee voice to an effective speak up system

Having the right culture is a critical component of an effective speak up system. If employees aren’t confident in speaking up regardless of the consequences, then no reporting system will be fully effective. But how do you encourage employees to come forward and what systems do you need in place to effectively respond to the issues that are raised?

In this session the panel will explore:

- Encouraging employee voice –the barriers and drivers

- What does the research tell us?

- How do we make sure we listen and respond effectively?

- What supporting systems and processes do we need in place?

- Employee voice in the contex of the EU Whistleblowing Directive and new legislation in The Netherlands

Confidential person: 20% rule. Does it work? (Croatian case)

According to Croatian Whistleblower Protection Act, a confidential person is an employee appointed to receive internal reports of irregularities and conducting proceedings in connection with the reporting of irregularities. A confidential person must be appointed at the proposal of at least 20% of employees.
